These Terms of Service ("Terms") govern your access to and use of the Impact Motors Kenya website, web application, mobile tools, showroom services, and related digital platforms and integrations (collectively, the "Services") provided by Impact Motors Kenya ("Impact Motors", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements, that all information you provide is accurate and complete, and that you will keep it up to date. If you use the Services on behalf of a business or other organization, you represent that you are authorized to bind that entity to these Terms.
Impact Motors provides vehicle sales, trade-ins, vehicle sourcing, financing facilitation, and related dealership services through its website, app, showrooms in Nairobi and Mombasa, and digital channels. The Services may be used to browse vehicle listings, submit inquiries, request financing or quotations, book test drives, and interact with our promotional content. We may add, change, suspend, or remove features of the Services at any time, and we may impose limits on certain features or restrict access to parts of the Services without notice or liability.
All vehicle listings shown through the Services, our social media channels, or third-party platforms are subject to availability. Specifications, prices, mileage, financing terms, features, and images are provided for informational purposes only and may change without notice. Listings do not constitute a binding offer, and the display of a vehicle does not guarantee that it is available or that it will be sold at the price shown. We make reasonable efforts to keep information accurate, but we do not warrant that listings, descriptions, or pricing are error-free. Final vehicle details, price, and terms are confirmed in writing at the point of sale.
Where you place a deposit, make a payment, or apply for financing through the Services, you agree to provide accurate payment information and to pay all amounts due. Deposits and payments may be processed through third-party providers (such as M-Pesa / Safaricom or our banking partners), and your use of those services is also subject to their terms. Financing offered through Impact Motors is subject to eligibility, credit assessment, approval, and a separate financing agreement. Any payment terms, refund conditions, and ownership-transfer requirements are set out in the relevant sale, deposit, or financing documents and prevail over any general description in these Terms.
Certain features may require an account or the submission of personal information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Administrative and staff accounts that connect business assets (such as social-media accounts) are limited to authorized Impact Motors personnel acting within the scope of their authority. You must notify us promptly of any unauthorized use of your account or any other breach of security. We are not liable for any loss arising from unauthorized use of your account where you have failed to keep your credentials secure.
Impact Motors operates its own official accounts on platforms including TikTok, Facebook, Instagram, and WhatsApp to publish dealership marketing content. Where authorized Impact Motors staff connect the dealership's official TikTok account through TikTok Login, the integration uses the TikTok Login Kit and Content Posting API to upload and publish dealership-owned vehicle videos and photo content to that account, using only the permissions described in our Privacy Policy.
In using these integrations, Impact Motors and its authorized users agree to comply with the TikTok Terms of Service, TikTok Community Guidelines, and TikTok Developer Policies, as well as the policies of any other connected platform. The integration is used exclusively to manage Impact Motors' own accounts and content; it is not used to access or post to any third party's personal social-media account. You may revoke or disconnect any connected account at any time as described in our Privacy Policy.
If you submit content to us — including inquiries, reviews, trade-in details, images, documents, or other materials — you represent that you have the right to do so and that the content is accurate, lawful, and does not infringe the rights of any third party. You grant Impact Motors a non-exclusive, royalty-free licence to use, store, and process that content for the purpose of providing and improving the Services. You must not submit content that is unlawful, defamatory, obscene, fraudulent, or that contains personal data of others without their consent. We may remove or refuse to publish any submitted content at our discretion.
All content provided through the Services — including the Impact Motors name, logo, vehicle photographs and videos, listings, text, graphics, and software — is owned by or licensed to Impact Motors and is protected by applicable intellectual-property laws. You may not copy, reproduce, scrape, distribute, modify, or create derivative works from our content without our prior written permission. Marketing content that Impact Motors publishes to its own social-media accounts (including TikTok) remains the property of Impact Motors or its licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than the limited right to use the Services as permitted here.

The Services integrate with or link to third-party platforms (including TikTok, Meta, and Google) and rely on third-party providers for hosting, messaging, analytics, and payments. Your use of those platforms is also governed by their own terms and policies, and Impact Motors is not responsible for the content, practices, availability, or security of third-party services. Any dealings you have with a third party through the Services are solely between you and that third party.
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Impact Motors does not warrant that the Services will be uninterrupted, error-free, or secure, or that listings and information will always be accurate or current. Any reliance you place on information provided through the Services is at your own risk.
To the maximum extent permitted by law, Impact Motors and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising from or related to your use of (or inability to use) the Services, vehicle listings, or related content, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
You agree to indemnify and hold harmless Impact Motors and its directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any applicable law or third-party right.
We may suspend or terminate your access to the Services, or disconnect any connected third-party integration, at any time and without notice if we reasonably believe you have violated these Terms or any applicable law, or to protect the security or integrity of the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
Impact Motors shall not be liable for any failure or delay in performing its obligations where such failure or delay results from causes beyond its reasonable control, including acts of God, natural disasters, power or internet failures, network or platform outages, strikes, governmental action, or the failure of third-party providers.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy and any documents they expressly reference, constitute the entire agreement between you and Impact Motors regarding the Services and supersede any prior agreements on the subject.
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict-of-laws principles. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Kenya. Before commencing formal proceedings, the parties will use reasonable efforts to resolve any dispute amicably.
Impact Motors may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and post the revised Terms on this page. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
